Special Needs
Arizona definition of "Special Needs":
State requires that child is in the custody of the State or licensied child welfare agency and cannot be returned to the parent; that a reasonable but unsuccessful effort has been made to place the child wihtout adoption subsidy and that due to one of the following factors or conditions the child cannot be placed for adoption without adoption assistance:
Special needs" means one or more of the following conditions which existed before the finalization of adoption:
(a) Physical, mental or developmental disability.
(b) Emotional disturbance.
(c) High risk of physical or mental disease.
(d) High risk of developmental disability.
(e) Age of six or more years at the time of application for an adoption subsidy.
(f) Sibling relationship.
(g) Racial or ethnic factors.
(h) High risk of severe emotional disturbance if removed from the care of his foster parents.
Finalization
Adoption may be finalized in another state:
Before finalization can occur in Arizona, child must be in adoptive placement:
Be in the adoptive home at least 6 months but need not be an adoptive placement the whole time.
