The Association of Administrators of the Interstate Compact on the Placement of Children (AAICPC) was established in 1974 and consists of members from all 50 states, the District of Columbia and the U.S. Virgin Islands. The AAICPC has authority under ICPC to "promulgate rules and regulations to carry out more effectively the terms and provisions of this compact." The AAICPC obtains its Secretariat Services, as an affiliate of the American Public Human Services Association (APHSA).

Public Adoptive Placements-Requirements
The adoptive family must have a current (within 1 year) adoption home study which includes a criminal history/child abuse background check clearance (within 3 years) and full disclosure of the child's history and needs must occur prior to adoptive placement of the child. Monthly home visits must occur during the mandatory 6 month pre-finalization supervision period. This supervision period may be reduced to 3 months if the child lived with the family as a foster care placement for a minimum of six (6) months preceeding the adoptive placement. Adoption Assistance Agreements must be completed prior to the finalization of the adoption. Written consent of the Director of the Department of Health and Welfare is required at the finalization of the adoption of any Idaho child in the legal guardianship of the Department. Written consent of the legal guardian (or designee) of any child being adopted must be obtained by the Court as part of the adoption finalization.

Idaho definition of "Special Needs"
Idaho's definition of special needs can be found at IDAPA 16.06.01.900. A child who cannot or should not be returned to the home of the parents as evidenced by an order from a court of competent jurisdiction terminating parents rights or its equivalent; and (a) the child has a physical, mental, emotional or medical disability or is at risk of developing such a disability based on the child's experience of documented physical, emotional or sexual abuse or neglect; or (b) the child's age makes it difficult to find an adoptive home; or (c) the child is being placed for adoption with at least one (1) sibling; and (d) the state must make a reasonable but unsuccessful effort to place the child with special needs without a subsidy, except in cases where it is not in the best interests of the child due to his significant emotional ties with the foster parent(s) or relative(s) who are willing to adopt the child.

Criminal History Background Checks
IDAPA 16.05.06.001.03. Policy. It is the Department’s policy to conduct fingerprint-based criminal history and background checks on individuals who have completed a criminal history application. The criminal history applicant is required to disclose any pertinent information of crimes or offenses that would disqualify the individual from providing care or services to vulnerable populations. The Department obtains information for these criminal history and background checks from the following sources:
a. Federal Bureau of Investigation;
b. Idaho State Police Bureau of Criminal Identification;
c. Any state or federal Child Protection Registry
d. Any state or federal Adult Protection Registry
e. Any state Sexual Offender Registry
f. Office of Inspector General List of Excluded Individuals and Entities;
g. Idaho Department of Transportation Driving Records;
h. Nurse Aide Registry;
i. Other states and jurisdiction records and findings.
Background Screening
State or Local Criminal Record Checks Requirements/Process:
The Department's criminal history and background check is a fingerprint-based check. Ten (10) rolled fingerprints must be collected from the individual and submitted to the Department within the time frame for submitting applications as provided in Section 150 of these rules in order for a criminal history and background check request to be processed. The Department obtains fingerprints electronically at each of its fingerprint locations, or the Department’s fingerprint card must be used. A Department fingerprint card can be obtained by contacting the Criminal History Unit. (IDAPA 16.05.06.140)
Child and Family Services will provide the applicant with an agency number. With that number applicants go to the web site https://chu.dhw.idaho.gov and follow the instructions at the home page. The applicant and CFS will be provided with results.

General Definitions
Adoption
is the legal act of permanently placing a child with a parent or parents other than the birth parents. Adoption results in the severing of the parental responsibilities and rights of the biological parents and the placing of those responsibilities and rights onto the adoptive parents. After the finalization of an adoption, there is no legal difference between biological and adopted children.
The types of adoptions permitted by each state are governed by state law:
- Private Agency - are adoptions facilitated by a private licensed agency (i.e. domestic and international).
- Independent - are adoptions facilitated by an attorney, other intermediary, or adoption facilitator as defined by state law.
- Public - are adoptions facilitated by a public state or local agency and involve children who are in the custody of a state/local government agency.

is an individual who has been approved as a licensed foster parent and who has made an offer of an adoption commitment if the child becomes legally free.
Foster Care (Provider)
is any person other than a natural or adoptive parent with whom a child is in the care, custody, or guardianship of the State Child Welfare Agency and placed by said division, or with its approval for temporary or long-term care but shall not include any person with whom a child is placed for the purpose of adoption. Foster home means and includes private residences that are licensed, or specialized group homes.
Foster Care Maintenance Payments
means payments to cover the cost of (and the cost of providing) food, clothing, shelter, daily supervision, school supplies, a child's personal incidentals, liability insurance with respect to a child, and reasonable travel to the child's home for visitation. In the case of institutional care, such term shall include the reasonable costs of administration and operation of such institution as are necessarily required to provide the items described in the preceding sentence.
Legal Risk Adoptions
A legal risk adoption, or a legal risk placement, is one where a prospective adoptive child is placed in your home although the child is not yet legally free to be adopted.
License/certification/approval
means approval and or certification granted by the authority of a state regulatory agency.
Live Scan
is an electronic computerized technology which digitally scans fingerprints and provides immediate transmission of fingerprint records to the Department of Justice, FBI or other authorized receiving agency.
Parent
is a biological, adoptive parent or legal guardian as determined by applicable State law and is responsible for the care, custody and control of a child or upon whom there is legal duty for such care.
Relative
is a birth or adoptive brother, sister, stepparent, stepbrother, stepsister, uncle, aunt, first cousin, niece, nephew, as well as relatives of half blood or marriage and those denoted by the prefixes of grand and great including grand parent or great grandparent, or as defined in your state statute for the purpose of foster and or adoptive placements.
Relative-Foster Care
refers to a person who meets the definition of a relative as noted above and has been approved as a licensed foster parent.

If Idaho is the receiving state for placement, the sending state remains financially responsible. If foster payments are to be made to the Idaho resource, the amount is determined by the sending state agency according to sending state statute. As the sending state, Idaho will pay foster care reimbursement rates to licensed foster families as determined by the Idaho legislature under IDAPA 16.06.01.483-484 Child and Family Services. Family Alternate Care Payments for Monthly Room & Board: Ages 0-5: $395 Ages 6-12: $439 Ages 13-18: $584 Lowest level of need: $90 per month for a child requiring a mild degree of care for documented conditions including: -chronic medical problems -frequent time consuming transportation needs -behaviors requiring extra supervision and control -need for preparation for independent living Moderate Level of Need: $150 per month for a child requiring a moderate degree of care for documented conditions including: -ongoing major medical problems -behaviors that require immediate action or control -alcohol or other substance use disorder Highest level of need: $240 per month for a child requiring an extraordinary degree of care for documented conditions including: -severe emotional or behavioral disturbance -severe developmental disability -severe physical disability such as quadriplegia Additional Payments: For those children who require additional care above room, board, shelter, daily supervision, school supplies, personal incidentals, the Department may pay the family alternate care provider an additional amount. It is based upon an ongoing assessment of the child's circumstances which necessitate special rates as well as the care provider's ability, activities and involvement in addressing those special needs.

Idaho has a more narrow definition of relative than the ICPC definition. However, Idaho opts to apply the ICPC definition of relative for the purposes of ICPC cases.

Before Idaho will approve a child for an interstate placement with an RTF, Certification/verification of acceptance is required from the Residential Treatment Facility (RTF).
